Short Term Rental Enabling Legislation
Below are the final Ordinances adopted by the City Council and signed by Mayor Landrieu authorizing Short Term Rentals in the Comprehensive Zoning Ordinance and creating a licensing process in the City Code.
- Ordinance 27,204 MCS amended Chapter 26 of the City Code to create a licensing and enforcement process for Short Term Rentals.
- Ordinance 27,209 MCS amended the Comprehensive Zoning Ordinance to define Short Term Rentals as a land use, provided where such uses are authorized, and provided supplemental standards for their operation.
Additionally, the following Ordinances were adopted to provide funding to the Neighborhood Housing Improvement Fund and to authorize the City to enter into an agreement with Airbnb, Inc. for the collection and remittance of taxes:
- Ordinance 27,210 MCS provides for a fee of $1.00 per rental night of Short Term Rentals to be deposited into the Neighborhood Housing Improvement Fund.
- Ordinance 27,218 MCS authorizes the Mayor to enter into a Cooperative Endeavor Agreement with Airbnb, Inc. for the reporting, collection, and remittance of hotel sales and use taxes and hotel occupancy privilege taxes for booking transactions conducted on their internet-based platform.
