Assistant City Attorney (Municipal and Traffic Court)

The City Attorney’s Office for the City of New Orleans (the “City”) is currently seeking a qualified attorney to join the Municipal and Traffic Court Division of the Law Department.  The Law Department prosecutes municipal misdemeanors, state misdemeanors, and traffic offenses brought before the Municipal and Traffic Court as well as juvenile traffic offenses in Juvenile Court.  The Assistant City Attorney will represent the City in all Traffic Camera Safety Program administrative proceedings and appeals therefrom (most administrative decisions reached in these adjudications are appealable to Municipal and Traffic Court).  This work includes legal research, judge/jury trials, administrative hearings, motion practice, appellate practice, and mediation/settlement negotiations.

Duties and Responsibilities

The Assistant City Attorney will be expected to perform the following duties and responsibilities, among others:

  • Assist with the administration of Traffic Camera Safety Program adjudication processes and procedures, in conjunction with the Chief Deputy City Attorney for Municipal and Traffic Court.
  • Present enforcement cases on behalf of the City at administrative hearings.
  • Represent the City in appeals of enforcement actions in court, as required.
  • Assist with preparing policies and procedures related to administrative enforcement proceedings and enforcement processes.
  • Conduct independent or collaborative legal research and draft pleadings and legal memoranda.
  • Represent the City of New Orleans at administrative hearings, court proceedings, depositions, and other legal proceedings.
  • Review Traffic Camera Safety Program policies, monitor and ensure legal compliance, and advise management on methods of guarding against legal liability, as required.
  • Review special projects and proposals to ensure compliance with departmental objectives and applicable laws, rules, and regulations, as required.
  • Review and advise on the implications of new or revised laws affecting the Traffic Camera Safety Program, as required.

Qualifications

  • Applicants must be licensed attorneys, in good standing and admitted to practice law before the Supreme Court of Louisiana, and must be domiciled in Orleans Parish.
  • Two or more years of full-time experience as a practicing attorney is desired.  Experience in litigation, specifically in administrative enforcement actions and/or defense of the outcomes of such actions, is preferred.
  • Candidates should have knowledge of the rules regarding administrative enforcement procedures as well as knowledge of the rules of evidence and civil procedure.
  • Candidates should also have knowledge of the statutory and constitutional laws of the State as well as knowledge of applicable Federal law.  Candidates should also have knowledge of state and local law and ordinances related to the City of New Orleans’ Municipal Code.
  • Ability to exercise independent judgment.
  • Ability to represent the City of New Orleans professionally and effectively.
  • Candidates should have a diverse background in working with the general public and a desire to serve the public on a daily basis.  A willingness to collaborate, a professional work ethic, and attention to detail are required.
